This website is operated by Fastrak Trading 650 (PTY) LTD trading as Fastrak. Throughout the site, the terms “we”, “us” and “our” refer to Fastrak.
These Terms and Conditions (“Terms”) govern your use of the Fastrak website at www.fastrak.co.za and any purchase you make from us. Please read them carefully before using the website or placing an order.
By using this website or placing an order, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, please do not use this website.
Nothing in these Terms is intended to limit or exclude any rights you have as a consumer under the Consumer Protection Act, 68 of 2008 (CPA), the Electronic Communications and Transactions Act, 25 of 2002 (ECT Act), or any other applicable South African law. Your statutory rights are not affected by these Terms.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. Our store is hosted on Shopify Inc. They provide us with an online e-commerce platform that allows us to sell our products and services to you.

The Privacy Policy forms part of these Terms and should be read alongside them. In line with the POPI Act, your personal information shall only be processed for purposes of facilitating the purchase transaction and the Supplier undertakes to store personal information in a safe and secure manner and not to share information with any third party, except if such third party is contracted to provide services related to the transaction.
4. Age Restriction
By using this website, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are under 18, you may only use this website with the involvement and consent of a parent or legal guardian. Fastrak accepts no responsibility for any misrepresentation of age.
5. Intellectual Property
All content on this website — including text, images, logos, product descriptions, and software — is the property of Fastrak or its licensors and is protected by South African and international intellectual property law. You may not reproduce, distribute, or otherwise use this content without our prior written permission.
Where you submit content to our website (such as product reviews), you grant Fastrak a non-exclusive, royalty-free licence to display, reproduce, and use that content on our website and in our marketing materials for as long as it remains published. You confirm that any content you submit is accurate, does not infringe any third-party rights, and does not contain offensive or unlawful material. We reserve the right to remove or edit any user-submitted content at our discretion.

These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act, 68 of 2008, the Electronic Communications and Transactions Act, 25 of 2002, and the Protection of Personal Information Act, 4 of 2013.

8.2 External Escalation
If you are not satisfied with our response, you may escalate your complaint to the National Consumer Commission (NCC) or refer the matter to the National Consumer Tribunal (NCT). These are the applicable dispute resolution forums under South African law.

9. Pricing, Product Information, and Availability
We make every reasonable effort to ensure that all product descriptions, images, pricing, and availability information on this website are accurate and current, in accordance with the CPA.
Errors may occasionally occur, including incorrect pricing, descriptions, or stock availability. Where an error is identified, we reserve the right to correct it and, where necessary, cancel the affected order. If an order is cancelled due to an error or unavailability, you will be notified and refunded in full without delay.
All prices are subject to change without prior notice and are valid only while stocks last. Placing an order does not guarantee availability. All orders are subject to confirmation and stock on hand at the time of processing.
9.1 Order Acknowledgement vs Acceptance
When you place an order, you will receive an automated email confirming receipt of your order and payment. This is an acknowledgement only — it is not acceptance of your order. Your order is only accepted once we have confirmed product availability with our suppliers and sent you a separate confirmation email stating that your order is being processed.
9.2 Pricing Errors
If we discover a pricing error before your order is accepted, we will contact you with the correct price and give you the option to reconfirm at the correct price or cancel for a full refund. If we cannot reach you, the order will be treated as cancelled and refunded in full.
10. Payments and VAT
All prices on the Fastrak website are quoted in South African Rand (ZAR) and are inclusive of Value Added Tax (VAT) at the applicable rate. Our VAT registration number is 4060205962. The price shown at checkout is the final product price, excluding any delivery or shipping fees, which will be clearly displayed and itemised separately.
A VAT-compliant tax invoice will be issued to you upon successful completion of your order. Payment processing and receipt of funds do not constitute acceptance of your order or confirmation of availability.
11.1 Payment Options
Fastrak Online is able to process: Apple Pay, Google Pay, Capitec Pay, Buy Now Pay Later, Mastercard, Visa, RCS, Zapper, Snapscan, PayJustNow and Payflex.
11.2 Credit and Buy-Now-Pay-Later
Fastrak does not provide credit directly. Any buy-now-pay-later or deferred payment options available at checkout are provided by third-party payment providers and are subject to their own terms and conditions. Fastrak is not a party to those arrangements and accepts no responsibility for them.
11.3 Laybys
Layby facilities are available exclusively at in-store locations and are not applicable to online purchases. Payment is to be made over a period of six (6) months. No upfront deposit is required to initiate a layby agreement. No interest will be charged on the outstanding balance. Goods will only be released to the customer upon receipt of full and final payment.
11.4 Electronic Funds Transfer (EFT)
Our website does not support EFT payments directly. If EFT is your preferred payment method, please contact us to request a quotation, as the quotation number will need to be used as the payment reference for your EFT. Please note that goods will only be released once payment has been received, verified, and cleared in our bank account.
Fastrak products are available exclusively in-store at our official branches or online via our secure website: www.fastrak.co.za.
Fastrak will never request payment into a personal bank account or ask you to make payment outside of our official checkout process.
12. Discount Codes, Coupons, and Promotions
From time to time, Fastrak may issue discount codes, coupons, or run promotional offers (“Promotions”). All Promotions are subject to these Terms and any additional terms stated in the relevant Promotion communication or on the website.
12.1 Validity
Each Promotion is valid only during the stated promotion period. Unless stated otherwise, Promotions do not depend on when an email is opened or viewed. A Promotion expires at the stated date and time (South African Standard Time — SAST).
12.2 Minimum Spend
Where a minimum spend is required, it applies to the cart subtotal of qualifying items in a single transaction, excluding delivery charges, payment fees, and gift cards or vouchers, unless stated otherwise.
12.3 How to Redeem
Discount codes must be entered at checkout before payment is completed. Discounts cannot be applied after an order has been placed. Unless stated otherwise: only one discount code may be used per order; codes may be limited to one use per customer; codes are not transferable, may not be sold, and have no cash value.
12.4 Exclusions and Stacking
Promotions may exclude certain products, brands, categories, or sale items. Unless stated otherwise, Promotions may not be combined with any other discount code, voucher, promotion, or store credit.
12.5 Cancellations, Returns, and Refunds
If an order is cancelled or refunded (in whole or in part), any discount applied will be treated as used and will not be reissued, unless required by law or expressly stated otherwise. Refunds are processed in accordance with our Returns Policy and applicable law. Discounts are not refundable as cash.
12.6 Misuse
Fastrak may refuse, cancel, or reverse a Promotion where misuse, fraud, prohibited resale, or a technical error-based redemption is suspected.
12.7 Amendment and Withdrawal
Fastrak may amend, suspend, or withdraw a Promotion where reasonably necessary, for example due to systOnline shipping orders are fulfilled dependent to the store availability closest to the shipping address. 13. Stock and Backorders
Online shipping orders are fulfilled by the Fastrak warehouse or by the store nearest to the delivery address, subject to stock availability. Click & Collect orders are fulfilled by the selected store; should the chosen store not have the item in stock, it will be sourced from an alternative location.
If a product becomes unavailable after you have placed an order, we will notify you as soon as reasonably possible. You will have the option to proceed with a delayed delivery, accept a suitable alternative, or receive a full refund. Where an order has not yet been accepted, Fastrak may cancel it due to supplier stock constraints and will issue a full refund.
14. Your Right to Cancel (Cooling-Off Period)
South African law gives you the right to cancel certain transactions within a specified period. These rights are set out below and are in addition to your rights under our Returns Policy.
14.1 Electronic Transactions — ECT Act Section 44
If you purchased goods from us through an electronic transaction (i.e., an order placed online), you have the right to cancel the transaction within 7 (seven) days of receiving the goods, without giving a reason and without penalty.
To exercise this right, you must notify us in writing within 7 days of receiving your order. Written notice may be sent to info@fastrak.co.za. You must return the goods to us in the same condition as received. The direct cost of returning the goods is your responsibility unless we agree otherwise.
You shall be entitled to return defective goods within 7 days from date of delivery or accepting delivery, in exchange for another product of comparable value or a refund.
Once we receive the returned goods, we will refund the purchase price within 30 (thirty) days.
This right does not apply to:
a) goods made to your specific specifications;
b) perishable goods;
c) goods that have been used or are no longer in a resalable condition;
d) digital products that have been downloaded or accessed;
e) goods requiring specific packaging which may have been destroyed in the process of accessing the product;
f) goods that have been disassembled, physically altered, affixed or attached, joined, added or blended or combined with or embedded within other goods or property
14.2 Direct Marketing — CPA Section 16
If you purchased goods because of a direct marketing communication from us (for example, an email or social media advertisement), you have the right to cancel the transaction within 5 (five) business days of the transaction date, without reason and without penalty.
To exercise this right, contact us at info@fastrak.co.za within 5 business days of placing your order. We will process a full refund within 15 (fifteen) business days of receiving your notice.
15. Limitation on Liability
IMPORTANT NOTICE — PLEASE READ THIS SECTION CAREFULLY
This section limits the liability of Fastrak in certain circumstances. In accordance with section 49 of the Consumer Protection Act, we draw this to your attention specifically. Nothing in this section limits any right you have under the CPA, the ECT Act, or any other applicable South African law. Your statutory rights are not affected.
To the extent permitted by applicable law, Fastrak will not be liable for any indirect, incidental, or consequential loss or damage arising from your use of this website, including but not limited to loss of data or loss of profit, where such loss was not foreseeable.
Fastrak will not be liable for any loss or damage arising directly from your own misuse of this website or mishandling of any product sold, resulting in any loss or damage or from circumstances beyond our reasonable control. The limitation of our liability shall apply to the extent that any risks pertaining to the product have been communicated to the consumer as part of the purchase transaction.
No method of transmission over the Internet is entirely secure. While we take reasonable steps to protect your information, we cannot guarantee the absolute security of data transmitted to or from this website.
16. Changes to These Terms
We may update these Terms from time to time to reflect changes in our business, legal requirements, or technology.
When we make material changes, we will update the “Last Updated” date at the top of this document and post a notice on our website. Where reasonably practicable, we will notify registered account holders by email at least 14 days before material changes take effect.
Your continued use of the website after the effective date of any changes constitutes your acceptance of the updated Terms.
